Terms of service
1. Subject
1.A These general terms and conditions of sale (the "General Terms and Conditions") are applicable to orders for products placed by internet with URATECH SWISS SARL ("URATECH SWISS") on the website www.uratech.ch. By placing an order with URATECH, the consumer (the "Buyer") accepts the application of these Terms and Conditions.
1.B No terms and conditions contrary to or deviating from these General Terms and Conditions shall apply between URATECH SWISS and the Buyer.
1.C The General Terms and Conditions also apply to all products delivered directly by URATECH SWISS and our partners whose products we sell.
2. Order
2.A URATECH SWISS accepts orders from Buyers with their registered office or domicile in Switzerland and abroad.
2.B By placing an order with URATECH SWISS, the Buyer declares that he/she has full legal capacity. Minors or persons under guardianship must, prior to any purchase, provide written authorisation from their legal representative or guardian before they can place an order.
2.C With regard to an order made in a country other than Switzerland, URATECH SWISS can in no way guarantee that you will or will not be charged taxes or customs duties. Any customs or import duties are charged once the package reaches its destination country. These charges must be paid by the recipient of the package.
3. Conclusion of the contract
3.A For orders placed on the Internet, the Contract is concluded upon confirmation of the order by URATECH SWISS. This confirmation is sent to the Buyer after validation of his order by pressing the "confirm" button.
3.B URATECH SWISS accepts no liability for the fact that goods ordered cannot be delivered due to lack of available stocks, additional supplies or production.
3.C URATECH SWISS remains free to delete or change the products offered at its own discretion and at any time.
3.D Within 24 (twenty-four) hours after the conclusion of a Contract with URATECH SWISS, the Buyer may request URATECH SWISS to modify or cancel the Contract. URATECH SWISS remains free to accept or refuse the Buyer's request for modification or cancellation. URATECH SWISS may charge a fee without justification.
The Buyer may not, under any circumstances, modify or cancel a Contract with URATECH SWISS when he has ordered items that have been manufactured and/or personalised at his request or when the ordered items are already being delivered.
4. Prices
4.A The sale prices of the products are indicated in Swiss Francs (CHF).
In the case of Buyers with their registered office or domicile in Switzerland, the prices include VAT and any reductions applicable on the day of the order.
In the case of Buyers whose registered office or domicile is outside Switzerland, the prices do not include VAT, and URATECH SWISS can therefore in no way guarantee that you will or will not be charged any taxes or customs duties. Any customs or import duties are charged once the package reaches its destination country. These charges must be paid by the recipient of the package.
4.B Sales prices do not include delivery charges. The amount of the delivery costs is added to the selling price. For orders placed via the Internet, the delivery costs are indicated in the order summary ("basket").
4.C Once the order has been validated, the price of the order cannot be modified.
4.D Subject to the foregoing, URATECH SWISS is entitled to change the price of the goods offered at any time at its sole discretion.
5. Delivery costs
5.A The delivery costs are calculated in the order summary and are to be paid by the customer.
6. Delivery time
6.A The delivery times indicated in these General Terms and Conditions are given as an indication. They do not constitute a commitment. The Buyer is obliged to accept any delivery of products, even if the delivery is received after the stated deadline.
6.B An indicative delivery time is given for each item in the "product sheet". For internet orders, the delivery time for an entire order is indicated in the order summary ("basket").
6.C Failure to comply with a delivery period does not give the Buyer any rights against URATECH SWISS.
7. Delivery
7.A Depending on the goods, deliveries are made by the Post Office, by the shipping service commissioned by URATECH SWISS or by the delivery services of our partners. Deliveries are made in Switzerland and internationally.
7.B If the Buyer does not take possession of the goods sent by post within 7 days, URATECH SWISS is entitled to consider the order as cancelled and to recover the goods. If a sales price has been paid, this will be refunded to the Buyer after deduction of the costs associated with the return of the goods.
7.C If the goods are delivered by the shipping service commissioned by URATECH SWISS, the Buyer and the shipping service will agree on a delivery day. If the Buyer does not take delivery of the goods on the agreed delivery date, URATECH SWISS shall be entitled to consider the order as cancelled and to recover the goods. If a purchase price has been paid, this shall be refunded to the Buyer after deduction of the costs associated with the delivery and return of the goods.
7.D If the goods are delivered by the delivery services of our partners, the latter's special delivery conditions shall apply.
8. Transfer of risk
8.A The transfer of risk - which includes the risk of loss as well as the risk of deterioration of the goods - passes to the Buyer at the time of receipt of the goods.
8.B If the Buyer does not take possession of the goods, the risk passes to the Buyer when the goods are returned to URATECH SWISS.
8.C If the Buyer returns goods to URATECH SWISS, the Buyer bears the risk until the goods are received by URATECH SWISS.
9. Terms of return or exchange
9.A Orders placed with URATECH SWISS may be returned or exchanged within fourteen (14) days from the date of shipment of the order by contacting URATECH SWISS customer service.
9.B Returned or exchanged items must be intact and complete, in their original packaging (with the label showing its references) and accompanied by the delivery note. If returned or exchanged items do not meet the aforementioned conditions, URATECH shall be entitled to return the goods to the Buyer and to charge him/her for them. In this case, the delivery costs may be charged to the Buyer.
9.C Items delivered in kit form that have been unpacked and assembled, items ordered to measure or customised, as well as items that have been tested, may not be returned or exchanged under any circumstances.
9.D Items delivered in kit form that have only been unpacked will be taken back for a flat fee of CHF 150 (one hundred and fifty francs), including VAT. This amount includes the return of the goods by the forwarding agency commissioned by URATECH SWISS as well as the reconditioning of the goods by URATECH SWISS. The amount is to be paid directly to the forwarding agency commissioned by URATECH SWISS on the day of the return. Provision 9.H also applies to making an appointment.
9.E In the case of returns, the goods must be returned by post and the costs of return are to be borne by the Buyer.
9.F In case of exchange of goods, the exchange must be made by La Poste and the return costs are at the expense of the Buyer.
9.G In the case of partial deliveries, the time limit begins to run upon receipt of each package.
9.H Items delivered by the shipping service commissioned by URATECH SWISS can be returned or exchanged by the same service. The Buyer who returns goods via the shipping service must first contact the customer service of URATECH SWISS in order to arrange for the return of the goods. The Buyer shall also bear the costs of the return.
9.I Subject to the provisions of 9.C and 9.D, in the event of the return of goods by the forwarding agency commissioned by URATECH SWISS, a flat-rate fee of CHF 50.00 (fifty francs) shall be charged to the Buyer. If the goods are delivered by our partner's delivery service, the return conditions of the service provider shall apply. The amount of the return costs will be added to the customer's account.
9.J URATECH SWISS cannot be held responsible in any way if the goods could not be delivered by the delivery service used. In certain exceptional cases, URATECH SWISS may offer a refund equivalent to the price of the order minus the delivery costs.
10. Payment
10.A Payment for the goods can be made on the basis of an invoice, by credit card (Visa, Mastercard and Postcard) or by gift cards.
10.B By placing an order with URATECH SWISS, the Buyer expressly authorises URATECH SWISS to check his creditworthiness with third parties.
10.C URATECH SWISS may unilaterally impose a method of payment on the Buyer or refuse to conclude a Contract with him.
10.D Irrespective of the method of payment used, the Buyer understands and accepts that his payment may pass through a financial intermediary who is subject to the legal obligations regarding money laundering.
Payment by credit card
10.E URATECH SWISS accepts payment by Visa, MasterCard and Postcard.
10.F In the event of payment by credit card (with the exception of Postcard), the Buyer's credit card will be debited at the time the order is confirmed. If an article is sold out or cancelled, URATECH SWISS will not charge the Buyer's credit card.
10.G In case of payment by Postcard, the Buyer's credit card will be charged at the time of ordering. If an article is sold out or cancelled, URATECH SWISS will refund the Buyer's card.
10.H URATECH SWISS is in no way liable for any charges related to a debit.
Payment by gift cards
10.I URATECH SWISS accepts payment by gift cards activated in the "Gift Card Area".
10.J Gift cards are not eligible for any other promotional offers.
10.K The amount of the gift card is deducted after the validation of an order and will only be visible in the Buyer's next account statement.
11. Reservation of title
Subject to provisions to the contrary provided for by the applicable legislation, ownership of the products delivered shall not pass to the Buyer until full payment of the products
12. Inspection of the product
12.A The Buyer must inspect the products within 2 (two) days of receipt and must immediately notify URATECH SWISS of any defect or damage to the products. If the Buyer fails to notify URATECH SWISS within the aforementioned period, the products shall be deemed to have been received in good condition, free of defects and damage, and accepted as is, with the exception of non-apparent defects.
12.B In the event of the discovery of a defect that is not apparent, the Buyer must immediately notify URATECH SWISS of the defect. The Buyer shall forfeit his rights in the event of late notification.
13. Warranty
13.A Subject to the provisions of 14.1 and 14.2, all products sold by URATECH SWISS are guaranteed for 2 years. The warranty shall commence on the date of delivery of the article and shall be evidenced by the invoice accompanying the product.
13.B For the sake of clarity, the warranty granted does not cover defects resulting from accident, mishandling, improper use or unauthorised modification or repair as well as defects that are the consequence of normal wear and tear over time of the Products.
13.C In order to claim a guarantee, the Buyer must send the defective goods under guarantee to URATECH SWISS at his own expense.
13.D If URATECH SWISS establishes a warranty claim, it may, at its sole discretion, replace the defective product and/or parts with another product deemed to be equivalent or with replacement parts or carry out a repair. If no equivalent product or spare parts are available or if it is not possible to repair the product, URATECH SWISS may, depending on its assessment of the extent of the defect, compensate the Buyer for the loss in value of the article caused by the defect or refund the purchase price in full.
13.E URATECH SWISS undertakes to use its best efforts to process the warranty claim within a reasonable time.
13.F UNDER NO CIRCUMSTANCES SHALL URATECH SWISS BE LIABLE TO THE BUYER OR ANY THIRD PARTY FOR ANY DAMAGES, INCLUDING INDIRECT OR CONSEQUENTIAL DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFIT, LOSS OF BUSINESS, LOSS OF PRODUCTION, LOSS OF CONTRACT, LOSS OF GOODWILL OR LOSS OF BUSINESS OPPORTUNITY, ARISING OUT OF OR IN CONNECTION WITH A DEFECT IN A PRODUCT. AS SUCH, BUYER WAIVES ANY CLAIM FOR DAMAGES IN CONNECTION WITH A DEFECTIVE PRODUCT. THE BUYER'S ONLY CLAIMS AGAINST URATECH SWISS ARE THOSE SET FORTH IN THIS ARTICLE IN CONNECTION WITH THE CONTRACT AS GOVERNED BY THESE TERMS AND CONDITIONS AND/OR ANY PRODUCT SOLD.
14. Protection of personal data
14.A When placing an order, personal data of a Buyer are collected and processed by computer.
14.B URATECH SWISS ensures that the data of its customers is processed in accordance with the legislation in force. The data recorded by URATECH SWISS is used in particular for the registration and processing of orders, the administration of personal customer accounts, the performance of marketing studies and the compilation of statistics. The purpose of the data processing is the improvement and quality control of the services as well as market research.
14.C The Buyer authorises and consents to URATECH SWISS to, among other things:
- to communicate to a third party all his data necessary for the collection of a debt or debts.
14.D The Buyer may, due to the processing of his data by URATECH SWISS, receive commercial proposals from other companies or organisations.
14.E The Buyer may at any time limit or prohibit the use or disclosure of his data for marketing and advertising purposes.
15. Amendment of the General Terms and Conditions
URATECH SWISS reserves the right to unilaterally modify its General Terms and Conditions at any time. Nevertheless, the Agreement shall be governed by the General Terms and Conditions in force at the time of its conclusion.
16. Applicable law and competent courts
16.A The Contract as regulated by these General Terms and Conditions, the General Terms and Conditions and all subsequent orders are governed by Swiss law.
16.B Subject to the other compulsory jurisdictions provided for consumer contracts, all disputes, differences or claims arising from or relating to the Contract and these General Terms and Conditions shall be decided by the competent courts in Geneva.
